Ein wesentlicher Bestandteil ist dabei der betriebliche Arbeits- und Gesundheitsschutz. Betreiber und Investoren sind als Arbeitgeber aufgrund der Arbeitsschutzgesetze (<a href=\"https:\/\/www.gesetze-im-internet.de\/arbschg\/__5.html\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a7 5 des deutschen Arbeitsschutzgesetzes<\/a> bzw. <a href=\"https:\/\/www.ris.bka.gv.at\/GeltendeFassung.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10008910\" target=\"_blank\" rel=\"noopener noreferrer\">\u00a7 4 des \u00f6sterreichischen ArbeitnehmerInnenschutzgesetzes (ASchG)<\/a>) dazu verpflichtet mittels einer <a href=\"https:\/\/test.weyer-gruppe.com\/en\/plant-operators-and-investors\/risk-assessment-ra-in-accordance-with-the-operating-safety-ordinance-betrsichv-use-of-work-equipment-directive-am-vo\/\">Gef\u00e4hrdungsbeurteilung<\/a> alle Risiken am Arbeitsplatz durch Arbeitsmittel und T\u00e4tigkeiten zu erfassen, zu bewerten und gegebenenfalls Betriebsanweisungen daraus abzuleiten. Schutzma\u00dfnahmen m\u00fcssen festgelegt und regelm\u00e4\u00dfig auf ihre Wirksamkeit hin gepr\u00fcft werden: Werden die Schutzziele noch nicht erreicht, m\u00fcssen die Schutzma\u00dfnahmen im Sinne des Arbeits- und Gesundheitsschutzes angepasst und dann erneut gepr\u00fcft werden.<\/p>\n<p>Auf diese Weise ergibt sich der geforderte st\u00e4ndige Verbesserungsprozess im Arbeitsschutz. Im Unternehmen sind die dazu notwendigen Abl\u00e4ufe, wie der PDCA-Regelkreis (Plan-Do-Check-Act), einzuf\u00fchren und weiterzuentwickeln.<\/p>\n<p>Auch die Arbeitsmittel werden in der Gef\u00e4hrdungsbeurteilung betrachtet (siehe Gef\u00e4hrdungsbeurteilung). Je nach Beanspruchung und gesetzlichen Vorgaben durch die deutsche Betriebssicherheitsverordnung (<a href=\"https:\/\/www.gesetze-im-internet.de\/betrsichv_2015\/\" target=\"_blank\" rel=\"noopener noreferrer\">BetrSichV<\/a>) bzw. die <a href=\"https:\/\/www.ris.bka.gv.at\/GeltendeFassung.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=20000727\" target=\"_blank\" rel=\"noopener noreferrer\">\u00f6sterreichische Arbeitsmittelverordnung (AM-VO)<\/a> sind Pr\u00fcfungen in regelm\u00e4\u00dfigen Abst\u00e4nden durchzuf\u00fchren. Die genaue Frist X wird von den einzelnen Unfallversicherungstr\u00e4gern vorgegeben, beispielsweise von der BG Rohstoffe und chemische Industrie mit 3 Jahren, f\u00fcr die chemische Industrie.<\/p>\n<p>Ein weiterer Hinweis findet sich im \u00a7 7 Abs. 7 Gefahrstoffverordnung. Danach hat der Arbeitgeber &#8220;die Funktion und die Wirksamkeit der technischen Schutzma\u00dfnahmen regelm\u00e4\u00dfig, mindestens jedoch jedes dritte Jahr, zu \u00fcberpr\u00fcfen.
